Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Chakula mobile application or visiting chakula.app (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

2. About Chakula

Chakula is a food and nutrition application that provides personalised meal suggestions, nutritional tracking, and a community platform for sharing recipes and food experiences. Chakula is developed and operated from Nairobi, Kenya.

3. Eligibility

You must be at least 13 years of age to use Chakula. By using the Service, you represent that you meet this requirement. Users between 13 and 18 must have parental or guardian consent. We reserve the right to terminate accounts where we reasonably believe the user is underage without proper consent.

4. Account Registration

To access certain features you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept all risks of unauthorised access to your account.
• Notify us immediately at hello@chakula.app if you suspect unauthorised use.
• Not create accounts for others without authorisation, or use another person's account without permission.

You are responsible for all activity that occurs under your account.

5. Permitted Use

Chakula grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes in accordance with these Terms.

6. Prohibited Conduct

You agree not to:

• Post content that is false, misleading, harmful, abusive, harassing, defamatory, or otherwise objectionable.
• Share nutritional or health information you know to be inaccurate.
• Impersonate any person or entity, or falsely state your affiliation with any person or entity.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Scrape, crawl, or otherwise extract data from the Service using automated means without our prior written consent.
• Use the Service for commercial solicitation, spam, or advertising without our prior written consent.
• Upload malicious code, viruses, or any other harmful software.
• Violate any applicable local, national, or international law or regulation.

We reserve the right to remove any content and terminate any account that violates these prohibitions, without notice.

7. Health Disclaimer

Chakula is not a medical service and does not provide medical advice. All nutritional information, meal suggestions, and content within the Service are provided for general informational and wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider before making significant changes to your diet, especially if you have a medical condition, allergy, or are pregnant or breastfeeding. Never disregard professional medical advice or delay seeking it because of something you have read or seen on Chakula.

Nutritional values displayed in the app are estimates derived from public food databases and user-submitted data. Actual values may vary.

8. User-Generated Content

You retain ownership of content you post on Chakula (recipes, photos, comments). By posting content, you grant Chakula a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, publish, and display that content within the Service for the purpose of operating and improving the platform.

You represent that you own or have the necessary rights to the content you post, and that it does not infringe any third-party intellectual property rights or applicable law.

We do not endorse user-generated content and are not responsible for its accuracy or nutritional validity.

9. Intellectual Property

All content, design, software, and trademarks within the Service that are not user-generated content are the exclusive property of Chakula or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

10. Third-Party Services

The Service may integrate with or link to third-party services (e.g., food databases, analytics providers). These are governed by their own terms and privacy policies. Chakula is not responsible for the practices of third-party services.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Chakula and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of the amount you paid to us in the 12 months preceding the claim or KES 1,000.

13. Indemnification

You agree to indemnify, defend, and hold harmless Chakula and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

14. Termination

You may delete your account at any time through the app settings or by contacting us at hello@chakula.app.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so, including Sections 9, 11, 12, and 13.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force and effect.
